Draft document This text is a starting template and has not yet been reviewed by a lawyer. It should be checked against Tanzanian law and RESTO's actual practices before launch.

These Terms of Service explain the rules for using RESTO. Please read them carefully. They are written to be clear, but they are still a legal agreement between your business and RESTO.

01 Agreement to these terms

By activating your account or using RESTO, you agree to these Terms on behalf of yourself and the restaurant or business you represent ("you" or "your business"). If you do not agree, please do not use RESTO.

If you are accepting these Terms for a business, you confirm that you have the authority to do so.

02 The RESTO service

RESTO is a web-based restaurant management platform. Depending on your plan, it helps you record orders, manage tables and takeaway, route orders to kitchen and bar stations, view sales and expense reports, and manage staff, roles and branches.

We are continually improving RESTO. Features may be added, changed or removed over time. We will not remove a core feature of your paid plan without giving you reasonable notice.

03 Accounts and eligibility

  • RESTO accounts are created by the RESTO team for approved businesses. You cannot create an account yourself; you receive an invitation to activate it.
  • You must be at least 18 years old and able to enter into a binding agreement.
  • The information you give us when we set up your account must be accurate and kept up to date.
  • You are responsible for keeping your login details secure and for everything that happens under your account, including actions by staff you invite.
  • You decide which staff members get access and what each role can see and do. Remove access promptly when someone leaves.
  • Tell us straight away if you believe your account has been accessed without permission.

04 Plans, trials and payment

RESTO is offered on subscription plans. The plan agreed with you, its price in Tanzanian shillings (TZS), the billing period and any applicable taxes are confirmed with you before your account is activated.

  • Free trials. If a free trial is offered, its length and terms are confirmed when we set up your account. At the end of the trial you will need to choose a paid plan to keep using RESTO.
  • Billing. Subscriptions are billed in advance for each billing period unless stated otherwise.
  • Price changes. We will give you notice before any price change takes effect on your subscription.
  • Late payment. If payment is not received, we may limit or suspend your account after giving you notice.
  • Refunds. Unless required by law or stated in your plan, payments already made are not refundable.

05 Your data

Your business data stays yours. This includes your menu, prices, orders, sales records, staff records and any information about your customers that you enter into RESTO.

You give us permission to store and process that data only so we can provide, secure and improve the service for you. How we handle personal information is explained in our Privacy Policy.

You are responsible for having the right to enter data into RESTO, including any personal information about your staff and customers, and for following the data protection laws that apply to your business.

06 Acceptable use

You agree not to:

  • use RESTO for anything unlawful, fraudulent or harmful;
  • try to access accounts, data or systems that are not yours;
  • interfere with, overload or disrupt the service or its security;
  • copy, resell or reverse engineer RESTO, except where the law allows it;
  • upload viruses or other harmful code.

07 Third-party services

Some features may connect to services run by other companies, for example mobile money or other payment providers. Their availability depends on those providers, and your use of them is also subject to their own terms. We are not responsible for services we do not control.

08 Availability and support

We work hard to keep RESTO available and fast, but we cannot promise it will always be uninterrupted or error-free. Planned maintenance, internet connectivity problems and events outside our control can affect access.

We recommend keeping your own records of important information. Support is available through the contact details on our website.

09 Intellectual property

RESTO, including its software, design, logo and content, belongs to us and our licensors. These Terms give you a limited, non-exclusive right to use RESTO for your business while your account is active. They do not transfer any ownership to you.

If you send us feedback or ideas, we may use them to improve RESTO without any obligation to you.

10 Suspension and termination

  • You can stop using RESTO and close your account at any time.
  • We may suspend or close an account that breaks these Terms, does not pay, or puts the service or other users at risk. Where reasonable, we will warn you first.
  • After your account closes, you will have a reasonable period to export your data before it is deleted, except where we must keep some records by law.

11 Disclaimers

RESTO is provided "as is" and "as available". Reports and figures in RESTO are based on the data entered into it, so their accuracy depends on that data. RESTO is a management tool and does not replace professional accounting, tax or legal advice.

12 Limitation of liability

To the extent permitted by law, RESTO is not liable for indirect or consequential losses, such as lost profits, lost revenue or lost data. Our total liability for any claim relating to the service is limited to the amount you paid us for RESTO in the three months before the claim arose.

Nothing in these Terms limits liability that cannot be limited under Tanzanian law.

13 Changes to these terms

We may update these Terms from time to time. If a change is significant, we will tell you in advance, for example by email or a notice in RESTO. Continuing to use RESTO after the changes take effect means you accept the updated Terms.

14 Governing law

These Terms are governed by the laws of the United Republic of Tanzania. We will always try to resolve any disagreement with you directly first. If that is not possible, disputes will be handled by the competent courts of Tanzania.
